Landmark family law consultation
05 Jun 2026
Yesterday the Government published a consultation to improve the rights of unmarried couples if their relationship ends through separation or death.
The consultation sets out proposals such as:
- ‘Cohabitants’ should be defined as couples who have lived together for at least three years or who share a child
- Unmarried couples should be given inheritance rights if their partner dies intestate
- Nuptial agreements would become legally binding
- Greater weight could be given to parties impacted by domestic abuse when assessing finances
The family law group Resolution has long campaigned for these reforms as cohabitants are the fastest growing family type. They argue that current laws do not reflect societal reality.
The short answer is “it doesn’t” at the moment. There is a consultation period until 14th August before any legislation can be introduced.
How does it affect me?
However, it may give you food for thought in terms of your own relationship. Are you in a cohabiting relationship and want to know your rights should you and your partner separate? Are you unmarried and have children and want to know how to protect them should you or your partner pass away?
